Terms of Service

The seller supplies a video and pickup logistics and authorizes Nearbay to prepare and organize the sale. Before publication, the seller must review item photos, ownership, condition, descriptions, prices and availability, and remove belongings they intend to keep.

AI prices and descriptions are estimates, not appraisals or guarantees. The seven-day plan depends on accurate information, seller cooperation, buyer demand, pickup access and an accepted dealer offer. A sale or dealer price is not guaranteed unless expressly agreed for that sale.

Dealers submit offers and proposed collection details using their private access link. An offer becomes selected when accepted in the service. Items offered only “if unsold” remain subject to the individual sale results and the available manifest at collection. Offers are versioned: a new version supersedes the previous version and only the current version can be accepted. Operations freezes the final item manifest and settlement before pickup; payment at pickup follows that manifest.

Dealers must honor their accepted offer and collection arrangement, inspect goods at pickup and pay Nearbay and the seller as shown in the final locked settlement. Nearbay coordinates the transaction and the AED 100 accepted-lot fee.

You retain your rights in the content you supply and grant Nearbay a non-exclusive, royalty-free license limited to operating and displaying your sale: storing, analyzing with AI, reproducing, cropping and displaying item photos and information, and sharing the approved catalog through the necessary providers. The license lasts as needed for these purposes and the retention periods in the Privacy Policy; it does not authorize reuse of your video for advertising unrelated to that sale. Do not upload private documents, images of people or content you are not permitted to use.

The worker attempts deletion of raw video after a successful scan; automatic deletion based on a 7-day object age is the fallback for remaining videos. Cropped photos are scheduled for deletion 30 days after the sale closes, except samples. Email delivery metadata expires after 30 days. Contacts support coordination and separately consented alerts. Reservations, settlements and audit records are retained as needed for operations and legal obligations. See the Privacy Policy.

Nearbay may restrict access or remove content to address fraud, unlawful goods, abuse or security issues. Do not bypass access controls or disclose private links to unintended recipients.

Nearbay provides organization and coordination, and does not independently certify item condition, ownership, safety or a participant’s ability to complete a transaction. Sellers remain responsible for their goods and representations; buyers must verify the items at pickup.

If a problem arises, contact Nearbay promptly with the sale and reservation details. Any limitation of liability is subject to applicable law and does not remove mandatory consumer or other statutory rights.

To the extent permitted by law, Nearbay is responsible for reasonably foreseeable direct loss caused by failing to meet its coordination obligations and is not liable for lost profits or indirect loss. Nothing excludes or limits liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or liability or rights that cannot lawfully be excluded or limited.

Fee or other material changes apply to new service arrangements; a price change for an existing arrangement requires agreement. We may suspend access or remove a sale for fraud, prohibited goods, abuse or security risks; contact us to request review.

Nearbay locks the dealer manifest and settlement; the seller cannot lock them. The dealer pays its AED 100 dealer fee to Nearbay separately and withholds the smaller of the agreed lot payment and the seller fee from that lot payment, sending the withheld amount to Nearbay. The dealer pays the seller the lot payment minus the withheld seller fee. Any seller-fee balance not covered by the lot payment must be paid before dealer pickup, using PayPal in USD at AED 3.6725 per USD, rounded up to the nearest cent. Nearbay coordinates dealer pickup once the settlement is up to date.

These Terms are governed by the laws of the United Arab Emirates, and the competent UAE courts have jurisdiction, subject to mandatory rights or jurisdiction rules that cannot be excluded by contract.

Reservations and waiting-list requests may trigger transactional confirmation, availability and reminder messages from +1 228 400 7471 through telefono, our platform, using Twilio and Meta WhatsApp Cloud API. We use your name, reservation code, items and pickup window; conversations are retained on the platform for 30 days. You can ask us to stop messaging by replying STOP or contacting hello@nearbay.net. If a message does not arrive, use the WhatsApp link on your receipt to coordinate.

If the seller allows it, Nearbay also publishes public catalog data (items, cropped photos, prices, availability, community and pickup windows) in machine-readable formats for AI assistants and search engines through an API, feed and read-only MCP. Seller or buyer personal details, exact addresses and private links are excluded. The seller can turn this off from their panel. Assistants can direct people to the Nearbay link to reserve; they cannot buy or pay on the seller’s behalf. Items are paid for in person at pickup.
